TERMS AND TERMS AND CONDITIONS OF SALE
PREAMBLE
These general terms of sale are agreed upon between MEDIATEC, Alberto Carlos Pinho Saraiva, with its registered office at Rua Ferreira De Castro 241 B, 3720-006 Baralhas-Ossela, tax identification number PT 230 237 665, and contact +351 913 412 871, hereinafter referred to as “MEDIATEC,” and individuals who wish to make purchases through the website www.mediatec.pt/en/, hereinafter referred to as “User.”
The parties agree that purchases made through the website will be regulated exclusively by this contract, excluding any previous conditions available on the website.
Article 1: PURPOSE
These general terms of sale aim to provide and define all necessary information to the User regarding the ordering, selling, payment, and delivery processes for purchases made on the website .
These conditions regulate all necessary steps to complete an order and ensure its execution between the contracting parties.
Article 2: ORDER
The User places an order by completing the purchase process presented on the website www.mediatec.pt/en/, adding the product(s) or service(s) they wish to purchase to the shopping cart.
To submit an order, the User must:
a) Register on the website www.mediatec.pt/en/, providing the requested information.
b) Log in (by entering the email and password chosen at registration).
c) Complete the information and select options available during checkout (delivery and billing address, shipping method, payment method, VAT ID, and the name to be included in the invoice).
The final confirmation of the order by the User represents full acceptance of the prices, product descriptions available for sale, and these General Terms of Sale, which will be the only ones applicable to the contract thus concluded.
The company will fulfill online orders only within the limits of available stock. If a product is unavailable, MEDIATEC will inform the User as soon as possible.
The invoice details are the sole responsibility of the User. Once issued, an invoice cannot be modified.
Order requests are valid for seven days unless placed under a promotional campaign with a different deadline. Prices, discounts, promotions, and offers cannot be guaranteed beyond this period. If payment is not received within this timeframe, the order cannot be validated. Any amount received after this date will be refunded or used in a new order.
Article 3: PAYMENT
On the website www.mediatec.pt/en/, MEDIATEC offers Users the following payment methods via Easypay - Institution of Payment Lda & SumUp:
Credit card (Visa, Mastercard) (Easypay & SumUp)
Multibanco reference (Easypay)
MB-Way (Easypay)
PayPal (PayPal)
Bank transfer (EasyPay)
When paying by credit card, the amount is debited from the User’s card immediately after the merchandise is shipped. If some ordered products are unavailable, their value will be credited back to the User’s card after order processing.
Article 4: DELIVERY
Orders are shipped within one business day after purchase. Delivery is carried out by CTT / InPost, depending on the customer’s shipping preference.
Shipping costs are added to the order, varying according to the total amount. These costs are displayed at checkout, with a minimum of €4 for InPost deliveries and €5 for CTT deliveries. Estimated delivery time is between one to three days, under the responsibility of the courier services.
Article 5: PRICES
Prices are listed in Euros, including taxes and applicable VAT at the time of payment.
If a price increase occurs for any product, the User will be informed immediately and may choose to complete the purchase (paying the difference) or cancel the order.
Article 6: CANCELLATION & RETURNS
Cancellation or return requests are handled individually by MEDIATEC. Requests must be submitted in writing via email to info@mediatec.pt within 14 days of purchase. Cancellation or return instructions will be provided by MEDIATEC through the same communication channel.
Refunds, whenever possible, will be processed using the original payment method. If this is not possible, the User must provide proof of payment and account or card ownership for a refund via bank transfer.
MEDIATEC guarantees a refund to the User within a maximum of 14 days after receiving the returned order.
Returned products must be in resalable condition, meaning in the same state as received, without any damage or anomalies.
If a product exchange results in a price difference (higher or lower than the initial amount), MEDIATEC will inform the User of the applicable adjustment conditions.
Article 7: PRIVACY POLICY
The processing of your personal data complies with legislation on data protection. These data, subject to electronic processing, will be stored in MEDIATEC’s databases for registration, presentation of other products and services, and institutional communication.
Unless explicitly objected to, the buyer agrees to the use of personal data collected in their order within the seller’s customer database. The buyer has the right to access and rectify their data at any time.
Article 8: ESSENTIAL CHARACTERISTICS OF OFFERED GOODS & SERVICES
Products listed in the electronic catalog and governed by these Terms of Sale feature the following characteristics:
Product details: Name, packaging, quantity, and specifications for each product are listed in the electronic catalog and included in the buyer’s order. Product images shown in the catalog are non-binding and do not hold the seller accountable.
Delivery area: The offer described in these Terms of Sale is limited to the same geographic area.
Availability: Products listed in the electronic catalog remain available as long as they appear in the catalog and while supplies last.
Article 9: DURATION OF THE OFFER
Offers listed in the electronic catalog remain valid while the catalog is online and while stocks last.
Article 10: OFFER ACCEPTANCE
The buyer accepts the offer by validating the electronic catalog via a "validation click" or their signature. All buyer details must be provided, including name, delivery address, and email.
The buyer’s order is confirmed in writing via email by the seller. This confirmation includes the product description, order quantity, price, VAT (if applicable), and delivery conditions, unless the confirmation is issued through a signed purchase order.
Article 11: DELIVERY CONDITIONS
The ordered product(s) are delivered by a carrier chosen by the customer at the time of ordering, to the address indicated in the buyer’s order. If the buyer is absent when the product from the electronic catalog is delivered, it is the buyer’s responsibility to contact the carrier to arrange a new delivery or collect the order from the warehouse. If the delivered product does not conform to the indications in the order note or if transport-related damages are observed upon delivery, the seller commits to remedy the issue.
The delivery time is indicated on the website. It is an estimate, and MEDIATEC cannot be held responsible if this timeframe is exceeded. In particular, exceeding this estimated timeframe due to force majeure—such as strikes or bad weather preventing deliveries—does not justify canceling the order, reducing the price paid, or providing compensation.
MEDIATEC commits to making every effort to deliver the order as quickly as possible once the order form is received. The customer accepts their rights and responsibilities based on legal codes and provisions upon installation.
The delivery times indicated in the order form are purely indicative, and any delays do not entitle the buyer to cancel the sale, refuse the goods, or claim compensation. Any complaints regarding non-conformity or missing items must be submitted within three days of receiving the order via registered mail.
MEDIATEC is exempt from its delivery obligations in cases of unforeseen circumstances or force majeure, such as total or partial strikes, floods, or fires. Ownership of the delivered or to-be-delivered products remains with MEDIATEC until full payment is made by the customer, although the risk transfers upon shipment.
MEDIATEC may charge a fee for any refusal of delivery or order cancellation. Shipments are covered by the Terms and Conditions of Portuguese postal service providers. Customers may request an alternative delivery service in writing, but additional costs are borne by the customer.
Orders shipped within Portugal are sent free of charge via CTT normal shipping, meaning no signature or tracking is provided. Consequently, MEDIATEC is not responsible for any loss or delivery delays, as tracking is impossible via this shipping method. The customer may choose tracked and signed shipping at the time of ordering, paying the additional shipping fee. In this case, MEDIATEC will provide a tracking number, and the customer is responsible for following up with the carrier. In all circumstances, MEDIATEC is not responsible for delays or losses once the package is in the carrier's possession.
Article 12: APPLICABLE LAW
This contract is subject to the Code of Obligations and may be modified at any time.
Article 13: RIGHT OF WITHDRAWAL
You have a 14-day resolution period from the receipt of your order to return a product that does not suit you, is defective, or does not comply with the order. Products must be returned according to our return procedure, in their entirety, intact, in perfect working order, and in their original packaging.
The right of withdrawal takes effect the day after the goods are received at the address indicated by the customer. The customer bears the cost of return shipping. Any refurbishment costs will be charged to the customer.
For items returned within the 14-day resolution period, customers may choose between a store credit valid for one month or exchanging the item for another in the store.
Article 14: RIGHT OF RETURN
You have a 14-day return right from the date of receipt for products purchased online or in-store. This period allows you to make an informed decision about your purchase.
Exceptions to the right of return: Some exceptions apply to this right. Returns will not be accepted in the following cases:
If items have been damaged for reasons unrelated to transport. Any transport-related damage must be reported immediately upon receipt.
Returned products will only be accepted if they are in perfect condition—intact, unused, sealed, and in their original, undamaged packaging.
Refunds: Refunds are processed only if the returned item is still sealed in its original packaging and undamaged. The refund will be issued in full as store credit equivalent to the product’s purchase price.
Return shipping costs: Return shipping costs are generally the sender's responsibility. However, customers may return items directly to our center located at 3720-006 Baralhas-Ossela, provided they bring their purchase invoice, which is required for the return process.
Article 15: WARRANTY EXCLUSION FOR ACCESSORIES
Scope of Warranty: MEDIATEC’s warranty applies only to the main device purchased. Accessories—including remote controls, power adapters, and any other items included in the box or purchased separately—are not covered by this warranty.
Defect Notification & Return Procedure: If accessories are defective, the customer must notify MEDIATEC within 14 days of purchase, sending the defective parts along with a description of the issue. Return shipping costs will be covered by MEDIATEC if the return follows our instructions. Items must be properly packaged for transport. Failure to comply voids any right to claim for accessories.
Limitations: Claims for material defects are not accepted beyond 14 days after purchase. The warranty does not cover damages caused by misuse, improper maintenance, accidents, modifications, or unauthorized repairs.
